CUSTOM INK COMMUNITY CHAMPIONS GRANT CONTEST 2019 OFFICIAL RULES

NO PURCHASE NECESSARY.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.  VOID WHERE PROHIBITED.


1) DESCRIPTION:  The Custom Ink Community Champions Grant Contest (the “Promotion”) is designed to give individuals the opportunity to nominate themselves or a community member for being a Charlottesville Community Champion to Custom Ink (the “Sponsor”).  An individual entrant who is nominated by another individual will be required to accept the entry and these Official Rules before participating in this Promotion. The Prizes will be awarded to the entrants whose entries are selected in accordance with these Official Rules.  Sponsor’s decisions will be final in all matters relating to the Promotion and winner eligibility.

2) ELIGIBILITY:  This Promotion is open only to legal residents of Albemarle County, Virginia who (A) are over the age of 18 at the time of entry; and (B) enter the Promotion through www.customink.com/cvillechampions (“Promotion Site”).  Employees of Sponsor, its parent companies, affiliates and subsidiaries, its participating advertising, promotions and other agencies as well as members of their families and/or those living in the same household as such individuals are not eligible to enter. Void where prohibited by law.  You must also have access to the Internet and a valid email address in order to enter. The Promotion is (a) governed by these Official Rules, (b) void where prohibited or restricted by law, and (c) subject to all applicable federal, state, and local laws and regulations. By entering, you agree that you have read and consent to be bound by these Official Rules and Sponsor’s privacy policy, available at https://www.customink.com/about/privacy. Eligibility is conditioned on the acceptance of these Official Rules at the time of entry.

3) HOW TO ENTER:   To enter, go to the Promotion Site during the Submission Period (defined below), follow the onscreen entry instructions (including providing your full first name, last name, email address, phone number, details about why you should be considered a Charlottesville Community Champion, and information about how you would use the prize earnings), and submit your entry (“Submission”). Submissions may be made beginning at 8:00 AM Eastern Time (“ET”) on Tuesday the ninth of July, 2019 and ending at 11:59 PM ET on Sunday the twenty-eighth of July, 2019 (“Submission Period”). By providing your email address, you agree to receive marketing emails from Sponsor. Limit one (1) entry per person. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different accounts, email addresses, identities, registrations and logins, or any other methods may void that entrant's entries and that entrant may be disqualified, in Sponsor’s discretion. Use of any automated system to participate is prohibited and may result in disqualification, in Sponsor’s discretion. In the event of a dispute as to any registration, the authorized account holder of the email account used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned to the winning email account. Each potential winner may be required to show proof of being the holder of the winning email account. Sponsor’s computer will be the official clock of the Promotion. 

4) SUBMISSION REQUIREMENTS:  Each Submission must also comply with the following:

A. Any Submission that fails to meet the Sponsor’s specifications may be disqualified at any time in Sponsor’s sole and unfettered discretion.

B. The Submission must be your own original work, created solely by you, and must not infringe the copyright, trademark, privacy, publicity, or other personal or proprietary rights of any person or entity.

C. Submissions that are lewd, obscene, sexually explicit, pornographic, disparaging, defamatory, libelous, obscene, non-family-friendly or Submissions that otherwise contain irrelevant or inappropriate content or objectionable material may not be submitted and may be removed at any time in Sponsor’s sole and unfettered discretion.

D. You may not be, nor may you work with parties in conjunction with your Submissions who are: 1) represented under contract (e.g., by a talent agent or manager) that would limit or impair Sponsor’s ability to display your Submission in any media form; or 2) under any other contractual relationship, including but not limited to guild and/or union memberships, that may prevent Sponsor from being able to use the Submissions worldwide in all media in perpetuity on a royalty-free basis, without any payment or fee obligations.

Sponsor reserves the right in its sole and unfettered discretion to disqualify any Submission that it believes violates or potentially violates any of the foregoing requirements or otherwise fails to comply with any provision of these Official Rules or the terms of service for the Promotion Site.  The decision of the Sponsor on this and all matters pertaining to the Promotion shall be final and binding.


5) WINNER SELECTION.  


A. Phase One (Judging): Each Submission will be individually judged by a panel of judges based upon the following weighted criteria: how compelling your story and vision/mission is (33.33%), you exhibit qualities of being a Change Driver (33.33%), and you exhibit qualities of being a Community Leader (33.33%)  The three (3) Submissions with the highest scores from the judges will be determined potential Finalists, subject to verification of eligibility and compliance with these Official Rules and the Promotion Site Terms of Service and a potential publicity background check. In the event of a tie, the Submission among the tied Submissions with the highest score in the “Community Leader” category will be deemed the winner. If ties remain, the Submission among the tied Submissions with the highest score in the “Change Driver” category will be deemed the potential winner.  Decisions of Sponsor are final and binding. The Finalists will be announced on or around Monday, the fifth of August 2019.

B. Phase Two (Public Voting): From 12:01 AM ET on the sixth of August 2019 to 11:59 PM ET on the eighteenth of August 2019 (“Voting Period”), registered Promotion Site users will be able to vote for the Finalist Submission that has the most audience appeal on the Promotion Site. Promotion Site users will be allowed one (1) vote per entry per registered account. The Finalist Submission with the highest number of votes at the conclusion of the Voting Period, as determined by Sponsor or its designee, whose decisions are final on this issue, will be deemed the potential Grand Prize winner, subject to verification of eligibility and compliance with these Official Rules, the Promotion Site Terms of Service, and a potential publicity background check. In the event of a tie, the potential Grand Prize winner will be selected in a random drawing among all tied entries. Sponsor will attempt to contact the potential Grand Prize winner and two (2) First Prize winners initially by telephone or email, in Sponsor’s sole discretion, on or about the twentieth of August 2019. Potential winner must respond within 72 hours of initial notification attempt or an alternate potential winner may be selected. Winners will be announced on or about the twenty-seventh of August 2019.

6) PRIZES:  


A. Grand Prize:  There will be up to one (1) Grand Prize, consisting of the following elements:

1. The winner may choose to designate a valid charity (subject to Sponsor’s approval, in its sole and utter discretion) to receive a $5,000 donation from Sponsor.  Alternatively, the winner may choose to accept $5000 in the form of a check from Sponsor, intended to support the winner’s community efforts to create positive change. If the winner chooses to receive this prize in the form of a check from Sponsor, the winner will be solely responsible for all taxes on the prize.

2. One (1) $5,000 voucher for custom merchandise from www.customink.com.  Voucher restrictions may apply. Sponsor will also provide a tax gross-up equal to 30% of the estimated value of the $5000 voucher in the form of a check for $1,500 which is intended to offset most, but not necessarily all, taxes due on the voucher portion of the Grand Prize.

3. Winner will be required to participate in one or more photo, video, and/or audio shoots that will be organized by Sponsor at times and locations selected by Sponsor in its sole discretion (subject to winner’s prior documented commitments) to document the winner’s receipt and planned use of the Grand Prize. Approximate Retail Value (“ARV”) of Grand Prize: $11,500

B. First Prize:  There will be up to two (2) First Prizes, each consisting of one (1) $2,000 voucher for custom merchandise on www.customink.com. Voucher restrictions may apply. Sponsor will also provide a tax gross-up equal to 30% of the estimated value of the $2,000 voucher in the form of a check for $600 which is intended to offset most, but not necessarily all, taxes due on the First Prize.  ARV of each First Prize: $2,600.
 

ARV of all Prizes:  Between $2,600 and $11,500.


7) CONDITIONS OF PARTICIPATION.  Prize is not transferable.  Taxes on Prizes are sole responsibility of the winner.  Winner may be required to complete and sign a Form W-9 before any prize can be awarded.  For individual prizes valued at $600 or more, the winner will receive a Form 1099-MISC tax form at year-end for the retail value of the prize.  No Prize substitutions or cash redemptions allowed except by Sponsor, who may substitute a Prize of equal or greater value if advertised Prize becomes unavailable. Entry into this Promotion constitutes entrant’s agreement to be bound by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this Promotion.  Return of any prize/prize notification may result in disqualification and selection of an alternate winner. Any potential Finalist or winner who cannot be contacted within a reasonable period of time after first attempted notification will forfeit his/her prize. Potential Finalist or prize winner (or parent/legal guardian if winner is a minor in his/her state of residence) may be required to sign and return an Affidavit of Eligibility/Liability & Publicity Release and agree to a background check within a reasonable period of time following the date of first attempted notification.  Failure to comply within this time period may result in disqualification and selection of an alternate Finalist or winner. Acceptance of the prize constitutes permission for, and winner’s consent to, Sponsor and its agencies to use the winner’s name and likeness for advertising and promotional purposes without additional compensation, unless prohibited by law.


By participating in the Promotion, winner agrees to release Sponsor and each of their respective parent companies, subsidiaries, affiliates, related companies and advertising, promotion and public relations agencies, and each of their respective officers, directors, employees and agents from any and all liability, loss or damage of any kind arising out of or in connection with their participation in this Promotion or with respect to awarding, receipt, possession, use and/or misuse of any Prize.  


Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Promotion or in the announcement of the prize.  An entrant may be prohibited from participating in this Promotion if, in the Sponsor’s sole discretion, it reasonably believes that the entrant has attempted to undermine the legitimate operation of this Promotion by cheating, deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other entrants, the Sponsor or associated agencies.


8) NO RECOURSE TO JUDICIAL OR OTHER PROCEDURES: To the extent permitted by law, the rights to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Promotion are hereby excluded, and any entrant expressly waives any and all such rights.  Entrants agree that these Official Rules are governed by the laws of Illinois.


9) INTERNET:  Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion via mobile phone or otherwise.  If for any reason the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or otherwise affect the administration, security, fairness, integrity, or proper conduct of this Promotion, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion or any portion thereof without further obligation or advance notice. Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion or any portion thereof at any time, and for any reason without further obligation or advance notice.  Sponsor reserves the right, but does not have any obligation, to select winners from eligible entries received as of the termination date. Sponsor further reserves the right to disqualify any individual who tampers with the entry process.


CAUTION: Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Promotion is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such entrant to the fullest extent of the law.


10) SEVERABILITY:  If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.


11) WINNERS’ LIST:  For a copy of the winner’s list, send an email with the following subject line “Custom Ink Community Champions Grant Contest Winner’s List” to Community.Champions@customink.com after approximately September 15, 2019 and before December 31, 2019.
